  3. Increases in the cost price of products or their components, which VERDANO could not have foreseen at the time the offer was made or the contract was concluded, may give rise to price increases.
  4. The consumer has the right to cancel a contract on the grounds of a price increase as referred to in paragraph 3, unless the increase is the result of a statutory provision.

Article 4 – Samples and models

  1. Where the Customer has received a sample or model of a product, they may not derive any rights from it other than that it serves as an indication of the nature of the product, unless it has been agreed in writing that the products to be supplied shall correspond to the sample or model.

Article 5 – Payments and payment terms

  1. VERDANOmag may require a deposit of up to 100% of the agreed amount upon entering into the contract.
  2. The Customer must have made a payment in arrears following delivery.
  3. The payment deadlines applied by VERDANO are strict deadlines. This means that if the Customer has not paid the agreed amount by the last day of the payment term at the latest, they are automatically in default, without VERDANO having to send the Customer a reminder or give notice of default.

  5. The right of return applies only to online purchases; products purchased in-store must be thoroughly checked by the customer for condition and signs of wear. As a large proportion of the products we sell show signs of wear and tear, no rights or obligations can be attached to them; the items are in the condition as seen in the showroom.

Article 27 – Limitation period

  1. Any right the Customer may have to compensation from VERDAN shall lapse 12 months after the event from which the liability arises, whether directly or indirectly. This does not preclude the provisions of Article 6:89 of the Dutch Civil Code.

Article 28 – Termination

  1. The Customer may terminate the contract if VERDANO fails to fulfil its obligations through its own fault, unless such failure does not justify termination due to its special nature or minor significance.
  2. If VERDANO is still able to fulfil its obligations, the contract may only be terminated once VERDANO is in default.
  3. VERDANO may terminate the agreement with the Customer if the Customer fails to fulfil their obligations under the agreement in full or on time, or if VERDANO becomes aware of circumstances that give it good reason to believe that the Customer will not fulfil their obligations.
